4. Get Witness Information
Bystander accounts from independent witnesses are among the most valuable evidence in a disputed liability case. Get names and phone numbers before anyone leaves.
5. Do Not Admit Fault
Do not apologize. Do not speculate about what happened. Do not agree with the other driver's version of events. Florida follows a modified comparative negligence rule — any admission can reduce your recovery or eliminate it entirely.
6. Report to Your Own Insurance — Carefully
Florida is a no-fault state. You are required to use your own Personal Injury Protection (PIP) coverage first, up to $10,000. Report the accident, but do not give a recorded statement without speaking to an attorney first.
