Injured in an Uber or Lyft Accident in Florida? Here's What You Need to Know

Rideshare accidents in Florida involve multiple insurance layers that most people don't know exist. Here is how Uber and Lyft coverage actually works — and what to do if you were hurt.

How Uber and Lyft Insurance Actually Works in Florida

Florida law requires Uber and Lyft to carry commercial insurance, but the coverage depends on what the driver was doing at the moment of the crash. There are three distinct phases:

Phase 1 — App Off: The driver's personal auto insurance applies. Uber and Lyft provide no coverage. If the driver's personal policy doesn't cover commercial activity (most don't), coverage can be complicated.

Phase 2 — App On, No Passenger Yet: The driver has logged into the app but hasn't accepted a ride. Uber and Lyft provide contingent liability coverage — up to $50,000 per person, $100,000 per accident, and $25,000 for property damage. This only applies if the driver's personal insurance doesn't cover the claim.

Phase 3 — Passenger in Vehicle or En Route to Pick Up: This is the most important phase. Uber and Lyft provide $1 million in liability coverage plus uninsured/underinsured motorist coverage. This applies whether you are the passenger, a pedestrian, or another driver hit by the rideshare vehicle.

If You Were a Passenger

You are in the strongest possible position. The $1 million policy applies as long as the driver had accepted a ride. Do not file a claim only through the driver's personal insurance — that's not where the real coverage is.

If Another Driver Hit Your Rideshare Vehicle

You may have claims against both the at-fault driver and against your own UM coverage if the at-fault driver was uninsured or underinsured. Documenting that you were in a rideshare vehicle at the time — through the app, screenshots, receipts — is important.

If You Were Hurt by a Rideshare Driver

Establish which phase the driver was in. Screenshots of the app, driver records, and Uber/Lyft internal data can confirm this. This data is obtainable but must be requested promptly before it is overwritten.

What Uber and Lyft Do After an Accident

Both companies have internal claims teams whose interest is minimizing payouts. They will reach out quickly. Do not give a recorded statement or accept any offer before consulting an attorney.

Steps to Take After a Rideshare Accident

  1. Screenshot your ride receipt and trip confirmation immediately
  2. Note the driver's name, license plate, and vehicle
  3. Call 911 and get a police report
  4. Seek medical attention — do not wait
  5. Photograph all injuries, vehicle damage, and the scene
